Court Throws Out Breach Of Promise To Marry Case After 15 Years Of Living Together

A High Court in Kumasi has dismissed a legal claim brought by a woman who accused her former partner of breaching his promise to marry her after they lived together for 15 years. The ruling came after the woman’s appeal was heard and rejected by the court.

The case began when the couple ended a long-term cohabitation arrangement, and the woman argued that during their time together the man had made a clear commitment to marry her. She said that because he did not fulfil that promise, he should be held legally responsible.

Initially, a lower court ruled against her claim, and she took the matter to the High Court in Kumasi seeking justice. However, the High Court agreed with the original judgment and dismissed her appeal, effectively ending the case in favour of her former partner.

Breaches of promise to marry are legal claims where one person argues they were harmed by another failing to honor a marriage commitment. Ghana’s courts have dealt with such cases in the past, but the law requires strong evidence of a clear, enforceable promise. In this instance, the High Court found that the evidence did not support the woman’s claim.

The ruling highlights how family law disputes involving long-term relationships can be complex, especially when they involve questions about the nature of promises made during cohabitation and whether they are legally binding.
